Hi there
Could anyone tell me whether Fernando Martinez is still flight-simming as I thought I read somewhere that he had left the hobby?
I am sitting here on over seventy 48TFW repaints of his F-4C/D and am getting on with those if the 81TFW.
If I think they are good enough to release I will need to obtain his permission as I have used his SEA colour scheme as a base texture and am simply lettering/numbering on top of it (with a few minor changes) and he will deserve more credit for the result than myself!
Any help - by pm - or reply to this post would be very welcome.

Hmm thanks for the info Mike.
What is the 'etiquette' in a case like that? His models are still available so one must assume that he has no problem with people repainting them etc.
Also, I remember reading in the MAIW forums about an AI F-104 and following a link to someones website who was going to release a model that someone else had done. Can't find any reference to it at all. Any ideas?

That would be Martin Grossman (gsnde) over at The Owls Nest, he got permission to release the models, with ai plans and repaints, but as of yet he has not done so, hes probably still getting them ready

The etiquette is straightforward: If you can't obtain explicit permission from the author in question, then you can't release it in the public domain.
Whether you choose to follow the etiquette is another matter. But be warned, going against it may earn you some serious flak.
Perhaps if someone knows (or knew) Fernando well, they might be able to advise on what his position would be in this case. Or they might not....

Thanks Dan, I will continue to sit on them!

I'm sure I'll get flak for this but o' well!
I understand the thought behind this but if the person hasn't been heard from & hasn't responded I think this should be an exception to the policy. As this is freeware it should be expected that there will be others using the author's work. I can understand if someone was using it for payware but this is a freeware community. I understand the original creator wants credit & they should receive it but I think that if they can't be contacted it should be allowed to be released. For example a copy right is only good for so long, so how long should one have to wait to release freeware from someone who can't be contacted........we keep this up & it only hinders our community.

I agree with you Bone184.
It has been some time since Mr Martinez has been heard of and he has not responded to previous packages released, even ones which have included the aircraft model. I appreciate the etiquette but there is only so much you can do. Release the lot or release the paints without the aircraft model if you feel more comfortable with that.

All I'm saying is that there are risks associated with not following the etiquette.
As I said, the etiquette itself is straightforward, but there is no law stating we must always follow it.
Any exceptions can only be evaluated from your own personal perspective. We cannot apply a "general" exception unless there is a community-wide consensus, and I can assure you there isn't.
If people want to use my work as a basis for their own projects, then we may all agree that I should be credited for that. However, I might not wish to be associated with the final freeware product due to its shoddiness. Just because I'm on a four year sabbatical while pursuing my career studying the indigenous folklore of Ulaan-Ude, doesn't mean I want my character besmirched through the hijack of my reputation for when I eventually return - never mind all the emails I receive about my shoddy work, wasting valuable data transfer over my satellite link.
Or I might not care. Just trying to illustrate the dangers of second-guessing an unknown mind.
Ultimately, the choice is yours.

Didn't want to start an argument
However, I understand both viewpoints. On the one hand (as I stated when I opened this thread) Fernando would deserve (and would receive) more credit than myself as he produced the original texture and I merely researched the aircraft involved and overpainted some of his texture, and added lettering, numerals and wing badges for the units involved.
On the other hand, I would not want to embarrass Fernando in any way by inadvertantly producing a substandard representation for one of his excellent freeware models and one that is using much of his own handiwork.
I think I will continue to sit on these for the time being and continue to strive for the perfection we have all become accustomed to through the great offices of MAIW.
My apologies for the late respose to these latest postings but I was in transit from Carlisle to my home in the Western Isles and it took me two days
